Terms and Conditions - Products

The following Conditions of Contract shall apply:

1. Orders
   Orders are only accepted upon and subject to the terms and conditions of sale contained herein. We reserve the right to alter these at any time.

2. Prices
   Prices are exclusive of VAT. All goods will be charged at prices ruling at the time of delivery.

3. Terms of Payment
   Our terms of payment are as follows:-

   1. Battery boxes and/or bulb safe boxes - strictly on a proforma basis, thus payment must be made before despatch;
   2. All other products - payment in 14 days

4. Interest
   The Company reserves the right to charge interest on late payments. The interest charge will be at the rate (as well after as before any judgement) of eight per cent (8%) per annum above the Base Rate of HSBC Bank plc. This applies for the time being calculated on the outstanding balance from the date due for payment to the date of receipt by the Company of all outstanding sums.

5. Ownership of Goods
   The title and property in goods supplied by the Company does not pass, until payment in full has been received by us; the risk in respect of such goods passes to the deliveree from the moment of delivery. The customer will not be entitled to deduct from or set off against any monies due or to become due from the customer in respect of any contract hereunder any sum or sums whatsoever which the company are or may become liable to pay the customer.

6. Delivery Periods
   The Company will make every effort to achieve quoted delivery dates and execute its other obligations under the contract but will not be under any liability whatsoever if (for any reason) delivery is delayed or prevented or performance is frustrated by events constituting "Force Majeure". In particular the Company shall not be liable for consequential loss.

7. Inability to Deliver
   If for any reason the buyer is unable or refuses to accept delivery of goods at the contracted time we reserve the right to charge any costs incurred for storage additional handling and transport charges.

8. Returns
   

   1. The Seller is under no obligation to accept return of goods supplied and credit the Buyer accordingly except in the following conditions:-
      1. Goods returned as being damaged in transit.
      2. Goods returned pursuant to a request by the Seller following a complaint of quality of goods
      3. Where in the Seller's opinion the goods delivered do not meet the description of the goods agreed between the Seller and the Buyer when the order was placed.
      Goods not required must be notified in writing within 3 days and returned within 21 days of receipt, in original packaging and in re-saleable condition. In all other circumstances, prior agreement of the Seller to the return of goods must be received by the Buyer.
   2. The Seller reserves the right to make a charge for the return of goods subject to circumstances in (a) above.
   3. Subject to circumstances in (a) above special orders cannot be returned.
   4. Returns can only be accepted on food, drink and chemical cleaning products if the goods are received in faulty condition, prior agreement must be obtained.

9. Cancellations
   Cancellations cannot be accepted without prior agreement. In the event of orders being cancelled we reserve the right to apply cancellation charges and to reclaim any costs directly or indirectly incurred. Cancellations must be given in writing.

10. Contract Basis
    The Contract shall be governed by English Law.

Terms and Conditions - Clients

The following Conditions of Contract shall apply:

1. Orders
   Orders are only accepted upon and subject to the terms and conditions contained herein. Rabbitt Recycling (UK)Limited reserve the right to alter these at any time.

2. Rebates
   No rebates will be paid for first three months until the quality and consistency of the materials are established. When values are quoted, the materials are expected to be clean, dry and free from contaminants and based on samples, data sheets and /or photographs supplied by the customer. The contractor /processor may also request to visit the customers' premises to inspect the materials.

   When collected if, in the contractor /processor's opinion, the materials are contaminated or do not conform to the sample previously supplied, the revenue potential reduces significantly. Under such circumstances Rabbitt Recycling (UK) Limited reserve the right to reduce pro rata the amount of rebate to the customer.

   In any case, all values are paid at the discretion of the re-processor whose decision is final. Rabbitt Recycling (UK) Limited accept no responsiblity for any nil or low payment by the contractor /processor.

3. Ownership of Goods
   The title and property in goods remains with the Company until payment in full has been made by the processor. The risk in respect of such goods passes to the deliveree from the moment of delivery. The customer will not be entitled to deduct from or set off against any monies due or to become due from the customer in respect of any contract hereunder any sum or sums whatsoever which the company are or may become liable to pay the customer.

4. Collection Periods
   Unless otherwise directed by the customer, all collection /delivery arrangements will be on a backload or least cost basis. The contractor /processor will make every effort to achieve quoted collection dates and execute its other obligations under the contract but will not be under any liability whatsoever if (for any reason) delivery is delayed or prevented or performance is frustrated by events constituting "Force Majeure". In particular Rabbitt Recycling (UK) Limited shall not be liable for consequential loss.

In the event of orders being cancelled Rabbitt Recycling (UK)Limited reserve the right to apply cancellation charges and to reclaim any costs directly or indirectly incurred. Cancellations must be given in writing. Fax or email is acceptable.

8. Terms of Payment
   Our terms of payment are as follows:-

   1. Battery boxes and/or bulb safe boxes - payment must be made within 14 days after receipt of box;
