Construction Industry

Seventy five million tonnes of commercial and industrial waste are produced in the UK each year.

The Landfill (England and Wales) Regulations 2002 aim was to reduce/prevent the use of landfill having detrimental effects on the environment. From October 30th 2007 a further amendment to the regulation was introduced to the effect that:

  • All non-hazardous waste has to be pre-treated before it can be disposed of in a landfill

  • Non-hazardous liquids can no longer be sent to landfill

The purpose of this is to reduce the impact of waste that is sent to landfill and to increase the amount of waste that is recovered and recycled. No waste will be accepted at landfill unless it can be shown to have been pre-treated. This includes checking of the duty of care paperwork, inspection of the load and auditing the waste producer's pre-treatment arrangements.

Pre Treatment

Pre-treatment will need to meet the "three point test".

  • It must be a physical, thermal or biological process

  • It must change the characteristics of the waste

  • It must do so in order to:

    • Reduce its volume, or

    • Reduce its hazardous nature, or

    • Facilitate its handling, or

    • Enhance recovery

All three criteria must be satisfied for all the waste to have been pre-treated. Compaction does not qualify as an acceptable pre-treatment.

Removing recyclable materials from the waste for recycling is one form of 'treatment' that will satisfy the new regulations and has the added benefit of reducing the weight against which landfill charges would be raised. This can be done either through a separate recycling collection or at a sorting facility. It is essential that a reasonable amount of the sorted or separated materials are diverted from landfill.

Undoubtedly the new requirements will result in an increase in the cost of compliance for waste producers.
